Welcome to AcreScout. These Terms of Service ("Terms") govern your access to and use of the website acre-scout.com and the services provided by AcreScout, operated by RETOR LLC ("AcreScout," "we," "us," or "our"). By accessing or using our website or services, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using AcreScout, you confirm that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to be bound by them. If you do not agree, do not access or use our services.
2. Description of Services
AcreScout provides educational and informational research reports related to rural land acquisition, including but not limited to feasibility analysis, federal and state incentive program identification, financing options, and acquisition structure information. All reports are informational only. AcreScout is not a law firm, tax advisor, financial advisor, registered investment advisor, real estate broker, or mortgage broker, and does not provide legal, tax, financial, investment, real estate, or lending advice.
3. Eligibility
You must be at least 18 years old to use our services. By using AcreScout, you represent and warrant that you meet this requirement.
4. Accounts and User Information
You may be required to provide certain information to access or purchase services. You agree to provide accurate, current, and complete information and to update it as necessary. You are responsible for maintaining the confidentiality of any account credentials.
5. Payment, Pricing, and Refunds
Paid services are described on the website with their associated fees. Payment is processed via third-party payment processors (currently Stripe). All sales are subject to our Refund Policy available at /refund-policy. Prices are subject to change with notice.
6. Intellectual Property
All content on AcreScout, including text, graphics, logos, reports, analyses, and software, is the property of RETOR LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may use reports we deliver to you for your personal, non-commercial use only. You may not redistribute, resell, or publicly display our content without written permission.
7. User Conduct
You agree not to: (a) use our services for any unlawful purpose; (b) attempt to gain unauthorized access to our systems; (c) interfere with the operation of our services; (d) misrepresent your identity or affiliation; (e) use our reports to engage in any activity that would violate any law, regulation, or third-party right.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. ACRESCOUT DOES NOT WARRANT THAT INFORMATION IS COMPLETE, ACCURATE, RELIABLE, OR CURRENT. ALL INFORMATION IS DRAWN FROM PUBLICLY AVAILABLE SOURCES AND IS SUBJECT TO CHANGE. YOU ASSUME ALL RISK FROM ACTING ON ANY INFORMATION RECEIVED FROM ACRESCOUT.
9. Not Professional Advice
NOTHING ON THIS WEBSITE OR IN ANY ACRESCOUT REPORT IS LEGAL, TAX, FINANCIAL, INVESTMENT, REAL ESTATE, OR LENDING ADVICE. BEFORE ACTING ON ANY INFORMATION PROVIDED BY ACRESCOUT, YOU SHOULD CONSULT A QUALIFIED LICENSED PROFESSIONAL IN THE RELEVANT JURISDICTION.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACRESCOUT AND ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless AcreScout, its owners, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any law or third-party right; (d) any action you take based on information provided by AcreScout.

Our website may contain references to third-party services, products, programs, or lenders. AcreScout is not responsible for the content, accuracy, or practices of any third party. Where AcreScout has an affiliate or compensated relationship with a third party, we disclose it in accordance with FTC 16 CFR Part 255.

We reserve the right to modify or discontinue our services at any time without notice. We may also update these Terms from time to time. Continued use of the service after changes constitutes acceptance.

These Terms are governed by the laws of the State of Connecticut, without regard to conflict of law principles. You agree that any dispute arising from these Terms or our services shall be resolved exclusively in the state or federal courts located in Hartford, Connecticut.
16. Dispute Resolution
Before initiating any legal action, you agree to first contact us at contact@acre-scout.com to attempt good-faith resolution. If we cannot resolve the dispute informally, any claim shall be subject to the governing law and jurisdiction provisions above.
17. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, Refund Policy, Informational Disclaimer, and any other policies referenced here, constitute the entire agreement between you and AcreScout.
